Civil Court Overview
Unlike other areas of law it is not usually possible to estimate costs with the same accuracy as you would expect, for example, in the case of a house purchase, but we will at every stage give you the fullest information possible.
We can provide representation in the following areas –
Court of Session – Scotland’s highest civil court. We work closely with Edinburgh solicitors and counsel when instructed in this forum.
Sheriff court – Simple Procedure and Ordinary Actions in courts throughout Scotland. This is where we undertake most of our contentious work – see the section below.
Employment Tribunals, where we represent both claimants and employers.
First Tier Property Tribunal, which now deals with most landlord and tenant disputes.
Sheriff Court
The sheriff courts hear a broad variety of cases including some very high value cases. We have wide (and lengthy) experience of representing clients in the following areas – Family law – see separate section.
Contract disputes, including building contracts, service agreements, debt recovery and insolvency.
Personal injury where we have access to a wide range of expert witnesses. There are special funding arrangements available for this type of litigation which we will be happy to discuss with you.
Property disputes – in relation to boundaries, access rights, liability for maintenance, to give just a few examples.
